Texas Governor Greg Abbott signed the Texas Responsible Artificial Intelligence Governance Act (TRAIGA) into law on June 22, 2025, which includes criminal prohibitions on AI-generated child pornography. The law took effect on January 1, 2026. It is one of the most comprehensive state-level AI regulatory frameworks in the nation.  Key provisions related to AI-generated child pornography Prohibited acts: The law prohibits developing, deploying, or distributing an AI system with the sole intent of producing, aiding in, or distributing child pornography or unlawful deepfakes. Impersonating a minor: It also outlaws the intentional development or distribution of AI systems that engage in sexually explicit text-based conversations while impersonating a minor under the age of 18. Expansion of criminal offenses: The Texas Penal Code was amended through Senate Bill 20 to create a state felony offense for the possession or promotion of obscene visual material that appears to depict a child under 18, regardless of whether it was created using AI or other software.  Enforcement and penalties The Texas Attorney General has exclusive authority to enforce the law. Penalties for violations are tiered depending on the offense's nature. The legislation also includes a "right to cure" provision, allowing companies to fix violations within 60 days of notice.  Context and history The law was passed following legislative efforts to address the threat posed by the malicious use of AI. Lieutenant Governor Dan Patrick named Senate Bill 20 a priority to update state law regarding new technology and close potential loopholes.
