One of the biggest legal myths in the UK is this: “If the police arrest you and then drop the case, the arrest must have been unlawful.” That is wrong. In England & Wales, the police do not need proof to arrest you. They only need reasonable suspicion at the time of arrest. That suspicion can come from many everyday things, including (but not limited to): • a witness allegation • CCTV placing you near an offence • matching a suspect description • being linked to someone under investigation • phone data or location evidence • messages or call logs • property found in your possession • inconsistent or changing accounts • intelligence reports • being named by another suspect Even if later on: ❌ witnesses withdraw ❌ evidence falls apart ❌ CCTV is inconclusive ❌ phones show nothing ❌ CPS refuse charge ❌ the case goes No Further Action …the arrest can still be completely lawful. Police actions are judged on what they knew at the time, not on the final outcome. This is why most civil claims against the police fail. To successfully sue the police, you’d usually need to prove things like: • no lawful power to arrest • no reasonable suspicion at all • false imprisonment • malicious prosecution • abuse of power or serious misconduct Those are high legal thresholds — and they are rare. Being arrested does NOT mean you are guilty. But being released without charge does NOT automatically mean the police broke the law. Know your rights properly.
